70-Day Supply Limit for Medical Marijuana
The Florida Office of Medical Marijuana Use (OMMU) updated the regulations regarding patient daily allotment and dosing. Here’s a breakdown of the changes and what they mean for you.
Starting on Monday, August 29, 2022, the OMMU will be updated pursuant to section 381.986(4)(f), Florida Statutes (F.S.), which states, in part, “The department [of Health] shall quantify by rule a daily dose amount with equivalent dose amounts for each allowable form of marijuana dispensed by a medical marijuana treatment center. The department shall use the daily dose amount to calculate a 70-day supply.” In compliance with Florida law, the Department of Health has published Emergency Rule 64ER22-8, Dosing and Supply Limits for Medical Marijuana, to determine daily dose amounts and 70-day supply limits for approved routes of administration of marijuana (excluding low-THC cannabis).
What this means for our patients?
You are capped at the amount of THC that will be sold to you based on a daily limit times 70 (days) per route of administration of products.
Smokeable Flower
Flower is an exception. You are capped at 2.5 ounces per 35 day period for flower. Read more about 35-Day Smokable Flower rolling limit here.
Here are the daily dose limits under this OMMU update:
Edibles
- Daily Dose Amount: 60mg THC
- 70-Day Supply Limit: 4,200mg THC
Inhalation (e.g., vaporization)
- Daily Dose Amount: 350mg THC
- 70-Day Supply Limit: 24,500mg THC
Oral (e.g., capsules, tinctures)
- Daily Dose Amount: 200mg THC
- 70-Day Supply Limit: 14,000mg THC
Sublingual (e.g., sublingual tinctures)
- Daily Dose Amount: 190mg THC
- 70-Day Supply Limit: 13,300mg THC
Suppository
- Daily Dose Amount: 195mg THC
- 70-Day Supply Limit: 13,650mg THC
Topical (e.g., creams)
- Daily Dose Amount: 150mg THC
- 70-Day Supply Limit: 10,500mg THC

Example
For edibles, the maximum daily dosage is 60 mg. Multiply 60 by 70 and the max you can purchase every 70-day period is 4,200mg. You can buy that all in one day or one week, but once you purchase 4,200mg you won’t be allowed to buy more edibles until the 70 day period expires.

*An aggregate (total) 70-day supply limit of marijuana, other than marijuana in a form for smoking, shall not exceed 24,500 mg of THC.
This means that you can not go over 24,500 mg total for all forms (exception is for smokable).
Request for Exception
You can request an exception to this rule.
Pursuant to section 381.986(4)(f)1., F.S., a qualified physician may request an exception to the daily dose amount for their qualified patient by electronically submitting the “Request for Exception” form in the Registry. Upon receiving the information and documentation required by the form and determining the form is complete, the Office of Medical Marijuana Use (OMMU) will approve or disapprove the complete “Request for Exception” form within 14 calendar days. Prior to the form’s approval, a qualified patient will only be authorized to obtain the daily dose amounts determined by the Rule.
What this request for exception means for our patients
Patients with no current exceptions
Our clinic can electronically request an exception. Each approved exception is valid for up to the duration of the certification; therefore, we will need to submit a new “Request for Exception” form with each new certification we create in which a daily dose amount exceeds the determined limits.
Exemptions are made based on whether they are medically necessary – we will not do increases for patients to access sales.
If you want an increase in your daily limit it will take 14 days for OMMU to approve/disapprove. Prior to the form’s approval, you will only be authorized to obtain the daily dose amounts determined by the Rule.
We advise patients to wait until their recertification appointment to increase milligrams.
Please plan to make your purchases per usual with the allotments we’ve already made. This will give our clinic time to assist patients needing exception forms immediately.
Patients who already have a certification that exceeds the new daily dose amount
If this certification was issued before August 29, 2022, it is valid for the remainder of your certification. But note, we cannot make any modifications to an existing certification. Under the law, if you would need a certification that exceeds the new limit(s), we have to submit a “Request for Exception” form.
Patients who transfer to Southern Comfort from another provider
If you are transferring to Southern Comfort Marijuana Clinic with an existing certification that has an approved exception from your previous physician, we have 7 calendar days to close that certification and resubmit a new “Request for Exception.”
